Introduction

• This website www.manoramahorizon.com and/or any part thereof ("Website") is owned by The Malayala Manorama Co. Ltd ("Site Owner"). For the purpose of these Terms of Use, the expression "User" shall mean any person (including a Registered User) who accesses or uses the Website and the expression 'Registered User' shall mean a User who has registered himself/herself with the Website for availing the services provided therein. The Site Owner hereby grants the User a non-exclusive, non-transferable, limited licence to use the Website, subject to the unconditional acceptance of the terms of use governing this Website. The User hereby agrees to familiarise himself/herself with the Terms of Use as well as other terms and guidelines found throughout this Website and abide by them. If the User is dissatisfied with the Website or any portion thereof, or with any of these Terms of Use, the User's sole remedy is to discontinue using this Website.
• The Website contains academic support content for students which comprises information relating to colleges (Said Colleges) and courses (Said Courses) offered by such colleges. The abovementioned college and course information is hereinafter referred to as the Said Information. The Said Information is obtained by the Site Owner from the Said Colleges and the Site Owner posts only the Said Information as provided by the Said Colleges. The Site Owner does not verify the accuracy of the Said Information provided by the Said Colleges and it is for the User to contact the Said Colleges and verify the accuracy of the Said Information relating to the Said Colleges or Said Courses.
• The Website is deemed to be used by the User when it is accessed by the User by any means and/or when it is loaded and/or continues to be loaded in the temporary or permanent memory of the User's computer or a similar system or in the internet browser thereof. The Site Owner's own records of the use of the Website and transactions concluded therein, maintained through computer systems or otherwise, shall be accepted as conclusive and binding for all purposes. The User's use of this Website may be terminated at any time by the Site Owner at the sole and absolute discretion of the Site Owner, without any reason or notice being required to be given to the User.

Users Account and Registration Obligations

• The User Shall be required to provide some personal information when the User creates a Registered User Account, including the User's email address, which is used to protect the Registered User's account from unauthorised access.
• If a User uses the Website, the User shall be responsible for maintaining the confidentiality of the User's ID and Password and for restricting access to User's computer, computer system and computer network. The User shall be responsible for all activities conducted under the User's ID.
• The User agrees, inter alia, to:-
  1. Provide true, accurate, current and complete information about the User in the registration form required to be filled in to create a Registered User Account (such information being the "Registration Data")
  2. Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provides any information that is untrue, inaccurate, not current or incomplete, or if the Site Owner has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms of use, the Site Owner has the right to indefinitely suspend or terminate the User's registration with the Website and refuse to provide the User with access to the Website.
• The Said Information is provided only for the personal information of the User and as a guide for academic support for students. Unless specifically agreed to by the Site Owner in writing, no content from this Website may be used, reproduced, transmitted, distributed or otherwise exploited in any way for commercial purposes. Site Owner will, in its sole discretion, terminate the accounts of, and Site Owner may refuse service to, any User who violates this Agreement. Site Owner shall have the sole authority to choose the manner in which the Said Information will be searched, displayed, accessed, downloaded, copied, and otherwise used on the Website and Site Owner shall have the right to modify the Said Information in the exercise of its rights under this Agreement. Site Owner reserves the right to remove without prior notice, all or any part of the content posted on the Website by the User. Site Owner accepts no responsibility for checking/verifying the accuracy of Said Information.
• Users, who are searching for the Said Information through the Website, must verify/confirm details of the Said Information as well as the accreditation, facilities, quality etc. on their own. Site Owner will not be responsible for accuracy or validity of the site information provided on the Website The User understands and acknowledges that the Website is intended to be an internet location through which the User may access information carried by Website in the database maintained by it. The term "service" would include the search tools through which the User can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. Users then select one or more of the items presented to view the full document/ record. The term Service does not mean that the Site Owner is acting as an agent either express or implied on behalf of any person. If the User comes to know of any information on the Website that is fictitious/false or offends the User in any manner, the User agrees to immediately send a complaint to support@manoramahorizon.com enabling the Site Owner to take appropriate action.
• The User shall not use the Website in any way that is unlawful, or harms the Site Owner or any other person or entity. The Site Owner's decision with regard to the above use shall be final and binding on the User. Any use of the Website or its related services that amounts to the use of the Website's resources or User submissions for the purpose of or has the effect of competing with or displacing the market for the Website content, or its User submissions is prohibited.
• The User understands and acknowledges that the User may be exposed to Said Information submissions that are inaccurate, and the User agrees to waive, and hereby does waive, any legal or equitable rights or remedies the User has or may have against the Site Owner or the Website with respect thereto, and agrees to indemnify and hold Site Owner, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to the use of the Website by the User.
• The User is prohibited from using another User's account without obtaining the prior permission of such other User. The User is solely responsible for the activity that occurs on the User's account, and the User must keep the Users account password secure. The User must notify the Website immediately, in the event of any breach in security or unauthorized use of the Users account. The Site Owner assumes no responsibility for the completeness and/ or availability of information posted/submitted by Registered Users on the Website.
• Although the Site Owner will not be liable for the User's losses caused by any unauthorised use of the Users account, the User shall be liable for the losses of the Site Owner or others due to such unauthorised use of the Users Account.
• The User agrees not to alter or modify any part of the Website or any of its related technologies. Further, the User shall not:-
  1. Reverse engineer, decompile, disassemble, copy, reproduce, distribute, modify, transmit, perform, publish or create derivative works from or in any way exploit any part of the Website in violation of the Terms of Use or the laws of any country.
  2. Create a database in electronic or structured manual form by systematically downloading and storing the entire Website or part thereof except such information as relates or concerns the User.
  3. Cache or permit caching by any person.
  4. Commit any act that violates the Site Owner's intellectual property rights in the Website.
  5. Engage in any fraudulent, abusive or illegal activity, including but not limited to any communication or solicitation designed or intended to fraudulently obtain the password or any private information relating to any other user.
  6. Use the Website to violate the security of any computer or computer network, crack passwords or security encryption codes, transfer or store illegal material including threatening or obscene material or engage in any kind of illegal activity.
  7. Run a mail list or any form of auto-responder, or spam on the Website or any processes that are run or are activated while the User is not logged on or engage in any virus attack or denial of service, attach or engage in any activity designed and/or intended to interfere with the working of Website for any duration of time.
• The User agrees not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, the Site Owner grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. The Site Owner reserves the right to revoke these exceptions either generally or in specific cases. The User agrees not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. The User agrees not to solicit, for commercial purposes, any other Users of the Website.
• In the use of the Website, the User shall otherwise comply with these Terms of Use and all applicable local, national, and international laws and regulations.
• The Site Owner reserves the right to discontinue any aspect of the Website at any time.

Payment

• Where Subscription Fees accrues it shall be payable at or within such time as stated in the invoice(s) issued by the Site Owner to the User. The Subscription Fees shall be paid by the User on demand. In case the user disputes the same for any reason whatsoever, he shall make the payment towards the Subscription Fees accrued till the resolution of the dispute. In the event of the Site Owner deciding the dispute in the User's favour, the Company shall refund to the User any excess amount paid by the User free of interest. In case of any delay in the payment by the User of any sums due, the Site Owner shall have the right to charge interest on the outstanding amount from the date the payment became due until the date of final payment by the User.

Account Termination

• The Site Owner will terminate a User's access to the Website if the User is determined to be in violation of the Terms of Use or of any applicable law.
• The Site Owner reserves the right to decide whether a User Submission is appropriate and is not in violation of these Terms of Use.
• The Site Owner may remove any User Submissions and/or terminate a User's access for uploading any material in violation of these Terms of Use, at any time, without prior notice and at the Site Owners sole discretion.
• The Site Owner reserves the right to deny, at its sole discretion, any User access to this Website or any portion thereof without notice.

Personal Information

• Activity.
  No information / registration details are required to access the Website.
• Account-Related Activity
  Certain other activities on the Website like uploading information require the User to have a Registered User Account. The User is required to provide some personal information when the User creates an account, which personal information includes the User's email address, which is used to protect the User's account from unauthorised access. A Registered User Account allows the User to access many of the Website's services that require registration.
• Usage Information
  The Site Owner may record information about the User's usage, such as when the User used the Website, the favourites the User subscribed to, the contacts the User communicated with, the information the User has viewed and the frequency and size of data transfers, as well as the information the User displayed on the Website (including UI elements, settings, and other information). If the User is logged in, the Site Owner may associate that information with the User's account. The Site Owner may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to Users to track which emails are opened by the recipients.
